These Website Terms + Conditions (“Terms”) govern your access to and use of heirmark.digital and related public Heirmark surfaces (the “Sites”). By accessing or using the Sites, you agree to these Terms. If you do not agree, do not use the Sites.

Who we are

The Sites are operated by Heirmark Holding Inc. (“Heirmark”, “we”, “us”). Brand-powered passport and experience surfaces may also display content controlled by the relevant brand.

Services and demos

Public verification tools, demo passports and “Demo Experience” content are illustrative. They do not constitute a live client deployment, a warranty of authenticity for any physical product beyond the stated demo identity, or legal advice. Unrecognised codes are not automatically counterfeit — see our Verification Disclaimer.

Accounts and programmes

Access to brand workspaces, intake, OMSX-aligned programmes and production identity services may be governed by separate agreements. Those agreements control if they conflict with these Terms for that programme.

Acceptable use

You agree not to misuse the Sites, including by attempting unauthorised access, disrupting services, scraping beyond normal browsing without permission, reverse engineering where prohibited, or using the Sites for unlawful purposes.

Intellectual property

Heirmark names, logos, Site design and content are owned by Heirmark or its licensors. You may not copy, modify or distribute Site materials except as allowed by these Terms or with prior written consent. Brand marks appearing in demo or passport surfaces remain the property of their owners.

User submissions

If you submit information through forms or communications, you grant Heirmark a licence to use that information to operate the Sites and respond to your request, consistent with our Privacy Policy.

Third-party links

The Sites may link to third-party sites or services. We are not responsible for their content or practices.

Disclaimers

THE SITES AND DEMO EXPERIENCES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEIRMARK AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SITES.

Indemnity

You agree to indemnify and hold harmless Heirmark from claims arising out of your misuse of the Sites or violation of these Terms.

Governing law

These Terms are governed by the laws applicable to Heirmark Holding Inc., without regard to conflict-of-law principles, except where mandatory consumer protections apply in your jurisdiction.

Changes

We may update these Terms by posting a revised version with an updated effective date. Continued use constitutes acceptance.
